Terms and Conditions Brand Name Suggestions and Trademark Registration Services & ROC Research

SERVICES

Unboxfame India Pvt. Ltd. will provide the following services:

• Develop and present you with a selection of potential brand names for your business.
• Conduct a comprehensive trademark search through a reputable database to identify potential conflicts with existing trademarks.
• Conduct a separate ROC (Registrar of Companies) search to identify potential conflicts with existing business names registered in India. (Note: This is an additional service and may incur separate fees.)
• Prepare and file a trademark application (subject to additional fees and agreement) on your behalf.

TRADEMARK SEARCH DISCLAIMER

While we strive to provide thorough trademark and ROC searches, they are not guarantees of availability. The Trademark Office or the ROC may still raise objections based on factors not identified in our searches. You acknowledge that the final decision on registrability rests with the respective office.

TRADEMARK OBJECTION AND OPPOSITION

• Our Role: We will inform you promptly of any objections raised by the Trademark Office and provide initial guidance on potential responses. However, we are not obligated to represent you in legal proceedings related to trademark objections or third-party oppositions.
• Client Responsibility: You are responsible for making all decisions regarding how to address objections or oppositions. This includes engaging legal counsel, if necessary, and covering any associated fees.
• Our Support: We may offer additional services to assist you in responding to objections or oppositions, such as drafting responses or providing referrals to trademark attorneys. These services will be subject to a separate agreement and fees.

LIMITATION OF LIABILITY

WE ARE NOT LIABLE FOR ANY DAMAGES ARISING OUT OF OR RELATED TO:

• The Trademark Office or ROC raising objections to your chosen brand name.
• A third party filing an opposition against your trademark application.
• Costs associated with legal representation required to address objections or oppositions.
• Delays or inability to register your chosen brand name.

CLIENT ACKNOWLEDGEMENT

By accepting our services and filing a trademark application through us, you acknowledge and agree to the following:

• The limitations of our trademark and ROC searches and potential for objections by the Trademark Office or ROC.
• Your sole responsibility for making decisions and incurring costs associated with addressing objections or oppositions.
• Our optional support services for objections/oppositions and their associated fees.

PAYMENT

Our fees for brand name development, trademark search, ROC search (if applicable), and trademark application filing are separate. Full payment is required before we commence each service.

ACCEPTANCE

By accepting our services and using any proposed brand name, you acknowledge and agree to these Terms and Conditions.
